SELLER OBLIGATIONS:
This puppy is a purebred Boston Terrier registerable with the
American Kennel Club. Upon execution of this contract, the seller does
hereby convey title and interest in the described Boston Terrier puppy to the
buyer (except for the terms listed herein).
Gabrielle Vogler has made every effort to provide you with a healthy puppy. Breeder
guarantees that all vaccinations and worming are current. This puppy has had a veterinarian exam by the date of sale.
This puppy's parents have been genetically tested by the Animal Health Trust in England for Juvenile Cataracts. This puppy will NOT have Juvenile Cataracts, but may carry it. I WILL NOT refund money for carrier puppies (carrier puppies DO NOT have or develop JC). If you are wanting to use your puppy for breeding, it is suggested that you do the test through the Animal Health Trust as a conscientious breeder.
It is the BUYER responsibility to have this puppy examined by a licensed Veterinarian of their choice within 3 days of taking possession of this puppy. IF the Puppy is found to have a life threatening congenital defect or health problem at this exam then a 100% refund will be given, provided the Breeder is contacted immediately (within 24 hours) after the exam by the veterinarian, and this puppy is promptly returned to Gabrielle Vogler, at no expense to the breeder, with a signed document from the veterinarian stating the defect or problem. Registration papers given at the time of sale must accompany the returned puppy to Gabrielle Vogler. ***Gabrielle Vogler will refund the purchase price, pending verification by the breeder’s veterinarian. Gabrielle Vogler will NOT be responsible for illness or health problems which are diagnosed after this time period, except where stated in this contract. *** Breeder will not be responsible for Parvo, Distemper, or Corona virus after 48 hours from sale date as these are such highly contagious diseases and they can be contacted immediately after leaving the Breeder.***Breeder NOT responsible for Hypoglycemia which may result from shipping.
Breeder further guarantees this puppy for 2 years (from the date of birth) against LIFE-THREATENING congenital defects. IF the puppy is deemed to have a life-threatening genetic defect, it must be returned immediately to me with registration papers, and a diagnosis from the vet. Upon verification from my vet that the puppy does have said genetic defect, your purchase price for the puppy (excluding shipping) will be returned 100%.
Specific exclusions to this guarantee:
1) Hypoglycemia
2) Cherry Eyes
3) Grade 1 Heart Murmur
4) Grade 1 Luxating Patella
5) Teeth alignment problems that do NOT affect normal eating/drinking functions.
6) Retained testicles (my puppies are sold as PETS, not breeders, unless other arrangements have been made in writing).
7) Allergies (including food, inhalant, contact) and/or allergic reactions.
8) Cosmetic defects-defects NOT affecting normal health or life.
9) Stenotic Nares-Pinched nostrils
In the unlikely event of this puppy’s death in the first two years after birth, due to a genetic defect, a statement from a veterinarian confirming such an event and cause is required before any action will be taken by the Breeder. ****Under no circumstances is this puppy to be euthanized without Breeder’s knowledge and consent. ****Under no circumstances will the breeder be responsible for veterinary or medical bills incurred.*****
*****IF THE BREEDER’S COPY OF THIS HEALTH GUARANTEE/SALES CONTRACT IS NOT RETURNED TO THE BREEDER WITHIN 2 WEEKS THE GUARANTEE/SALES CONRACT IS NULL AND VOID, AND YOUR PUPPY/PUPPIES WILL NOT BE GUARANTEED.
Transfer of dog ownership to another party renders this contract NULL and VOID, as I have no way of knowing who the puppy went to and what kind of care they would provide.*****
If at any time down the road you can NOT keep your puppy (whether it be days, weeks, months, years) I will take said dog back and find them a forever home. Do not send your dog to death by taking him to an animal control facility.
